Terms of
Trade
1.
Terms of trade are strictly paymentin full on receipt of goods, or with
approval within seven days(7days) from date of invoice.
2.
If payment is not received by the
due date, then Marketing
Essentials may refuse
delivery of further goods and stop further credit facilities.
3.
The Customer will pay all
collection and legal costs actually incurred by Marketing Essentials (including actual solicitor/client costs) that
are related to the collection or recovery of any unpaid account.
4.
All goods remain the property of Marketing Essentials until payment in
full has been received.
Interest
Payments not made on due date may, at the
Company’s sole discretion, bear interest from the date of the invoice at the rate of no less than
5% per month until paid (or at such rate as shall be in force at the date of
purchase).
Supply of Goods
We reserve the right to
supply 7% above or below the quantity ordered. The actual quantity will be
invoiced.
Deposit
We reserve the right to
ask for a deposit to secure order, the deposit amount or percentage may vary depending on the
individualc lient and the campaign circumstances.
Any deposit required is solely at the discretion of Marketing Essentials.
Order
Cancellation
Any charge or charges
for order cancellation is dependant on the stage of production, the client and the individual
campaigncircumstances.
Any charges associated with order cancellation is passed onto the client is solely at the
discretion of Marketing Essentials.
Marketing Essentials will not and cannot accept any costs involved for order cancellation, any
costs incurred will be passed onto the client including costs associated with artwork, samples and
any freight & handling costs.
Any overdue accounts as
a result of order cancellation will also incur collection costs (including legal fees) in the
recovery of any outstanding monies owed.
Any charges associated with order cancellation comply with the New Zealand Consumer Guarantees Act
1993.
Guarantee
All products are
guaranteed against manufacturing defects and complaints must be made in writing within 7 days on
receipt of goods.
Claims for defective goods will be settled by replacement and credits or refunds will only be
issued at our discretion.
Marketing Essentials shall not be liable for
any loss, damage, expense or inconvenience, of any kind, incurred, sustained or suffered by any
purchaser as a result of any defect or default in the product to which this warranty relates.
In particular (but not so as to affect the generality of the foregoing) Marketing Essentials shall
not be liable for any loss, damage, expense or inconvenience arising from:
1. use of products where goods are used or adapted for a purpose for which they are not designed or
the inappropriate use of any Marketing Essentials product.
2. and in all such cases the liability of Marketing Essentials (if any) shall be limited to the
parts and labour necessary for the replacement of the defective product and provided all
replacements are performed during normal working hours by Marketing Essentials, its employees,
suppliers or agents, designated by it to perform such work.
Marketing Essentials shall not be liable to replace any defective or faulty goods pursuant to
Clause1 of this warranty unless the purchaser proves to the satisfaction of Marketing
Essentialsthat the goods were defective or faulty at the time when delivery was taken of
them.
Proof of purchase will be required prior to inspection. Any claims pertaining to defective or
faulty goods must be made within seven (7 days) from receipt of goods.
No warranty condition, description or representation on the part of Marketing Essentials is given
or implied by this and any warranty condition description or representation as to the state of
qualityor fitness for any purpose of the goods, whether expressed or implied by virtue of the
operation of the NewZealand Consumer Guarantees Act 1993 is hereby expressly
excluded.

Marketing Essentials.

parties.
